What is the purpose of article 28 of the Turkish Citizenship Law No. 5901?
Pursuant
to Article 25 of the Turkish Citizenship Law No. 5901, our citizens who want to
leave their Turkish citizenship want to acquire the citizenship of another
state in order to have better living conditions and to benefit from economic,
social and political rights in the countries where they live and work. Persons
who obtained permission to renounce Turkish citizenship were closed from their
civil registry and were treated as foreigners, so they could only benefit from
the rights granted to foreigners by Turkish laws. For this reason, our citizens
were losing their vested rights in Turkey. Here, with the Turkish Citizenship
Law No. 5901, which entered into force on 29.05.2009 and amended by Law No.
6304, the scope of our citizens living abroad and the rights they will benefit
from in accordance with Article 28 of the Turkish Citizenship Law No. 5901 has
been expanded.
What is a Blue Card?
Official
document showing that those who are Turkish citizens by birth but lost their
Turkish citizenship by obtaining permission to leave and their descendants
specified in Article 28 of the Turkish Citizenship Law No. 5901 and that they
can benefit from the rights specified in the said article .
What is the Blue Card Register?
It
is the register in which the records of those who are Turkish citizens by birth
but lost their Turkish citizenship by obtaining permission to leave and their
descendants specified in Article 28 of the Turkish Citizenship Law No. 5901 are
kept in electronic environment.
Who can register to the Blue Card Holders Registry?
Those
who are Turkish citizens by birth but lose their Turkish citizenship by
obtaining permission to leave and their descendants specified in Article 28 of
the Turkish Citizenship Law No. 5901 can register.
Who cannot be registered in the Blue Card Holders Registry?

Persons who have been revoked/revoked/lost their Turkish citizenship cannot be
registered in the Blue Card Holders Register.

Persons who lost their Turkish citizenship by exercising their right to choose
cannot be registered in the Blue Card Holders Register.

Persons who are not Turkish citizens by birth, despite losing their Turkish
citizenship by obtaining a leave of absence, cannot be registered in the Blue
Card Holders Register.

Persons who are not Turkish citizens by birth despite losing their Turkish
citizenship due to their mother and/or father, who are allowed to leave, cannot
be registered in the Blue Card Holders Register.

Minor children whose parents still hold Turkish citizenship cannot be registered
in the Blue Card Holders Register. They must be recorded in the family
registers.
Will my ID number change when I register to the Blue Card Holders Registry?
The
records of people who are Turkish citizens by birth registered in the MERNİS
database but lost their Turkish citizenship by obtaining a leave of absence,
are transferred to the Blue Card Holders Register without changing the Turkish
Republic ID number.
The
descendants of the person registered in the Blue Card Holders Register, who are
not Turkish citizens, as specified in Article 28 of the Turkish Citizenship Law
No. 5901, are recorded in the Blue Card Holders Register, if they apply, and a
foreigner identification number is given to these persons.
What are the rights granted to persons registered in the Blue Card Holders Registry?

Those who are Turkish citizens by birth but lose their Turkish citizenship by
obtaining permission to leave and their descendants specified in the 28th
article of the Turkish Citizenship Law no. Provisions regarding national
security and public order are reserved.
*
Persons registered in the Register of Blue Card Holders do not have the right
to elect and be elected, to import vehicles or household goods with exemption,
and to do their military service. The acquired rights of these persons
regarding social security are reserved and they are subject to the provisions
of the relevant laws in the use of these rights.

Persons registered in the Blue Card Holders Registry cannot hold primary and
permanent public service positions based on a staff and subject to the public
law regime. However, they can be employed as workers, temporary or contracted
personnel in public institutions and organizations.
Who can benefit from the Blue Card?
Persons
registered in the Blue Card Holders Registry can benefit from the rights
provided by the Blue Card.
Who cannot benefit from the Blue Card?
Those
who do not fall within the scope of Article 28 of the Turkish Citizenship Law
No. 5901 are not given the said document.
Where should I apply to get a Blue Card?
It
is arranged upon the request of the persons registered in the Blue Card Holders
Registry. When applying this document, together with two photographs, with an
identity card or passport issued by the foreign authorities of which they are
nationals, the district registry offices in Turkey and our foreign
representative offices abroad are authorized to issue this document.
Is there any fee to be paid for the Blue Card?
Since
the Blue Card is within the scope of the Valuable Papers Law No. 210 dated
21/2/1963, the price of valuable papers determined by the Ministry of Finance
is requested every year.
In which cases is it possible to change the Blue Card?
Blue Card; It is possible to rearrange it if an application is made to the district
population directorates in the country and to our foreign representative
offices abroad, by presenting two photographs together with the identity
document or passport issued by the foreign authorities due to renewal,
replacement or loss.
Surname , date of birth, etc. on my blue card, how can it be corrected?
Regarding
the changes in the personal status of the persons registered in the Blue Card
Holders Registry, it has been transferred to the district population
directorates or our foreign representative offices;

If all kinds of forms, minutes, letters, papers and documents are duly approved
in accordance with the Regulation on the Implementation of the Population
Services Law No. 5490, the transaction is carried out.

Documents related to personal status, which are prepared in accordance with the
contract prepared and put into practice by the International Personality
Commission, and which have a specific formula and are issued in multiple
languages, are accepted directly without any process for approval and the
transaction is carried out.

If the decisions and administrative documents taken from the authorities of the
country of nationality of the persons registered in the Blue Card Register are
duly approved and approved, furthermore, in accordance with the provisions of
the Law No. 5718 on International Private and Procedural Law, dated 27/11/2007,
without requesting recognition or enforcement . makes.
Do I have to declare changes in my population events (Marriage, divorce, etc.)?
In
accordance with Article 8/A of the Population Services Law No. 5490, those
registered in the Blue Card Register are obliged to declare all kinds of
population events to the district registry offices in the country and to our
foreign representative offices abroad.
After I renounced my Turkish citizenship, I had a child. Can I enroll my child in the Blue Card Register?
Upon
notification to the district population directorates or our foreign representatives
based on the birth certificate issued by the official authorities, the child of
the person registered in the Blue Card Holders Register is recorded in the
register.
In
addition, descendants who want to be registered in the Blue Card Holders Register
must document the lineage with the blue card holder's descendants in a chain
manner, and if any, other descendants who are not registered in the Blue Card
Holders Register must be registered in the Blue Card Holders Register.
I renounced Turkish citizenship by obtaining permission. My wife still maintains Turkish citizenship. Can I enroll my child in the Blue Card Registers instead of the family registers?
Article
6 of the Turkish Citizenship Law No. 5901 “Citizenship acquired by birth
becomes effective from the moment of birth.” is in effect.
Article
7 of the Turkish Citizenship Law No. 5901 clearly states in which cases
children will acquire Turkish citizenship through lineage:
1)
A child born in or out of Turkey from a Turkish citizen mother or father in a
marriage union is a Turkish citizen.
2)
A child born out of wedlock to a Turkish citizen mother and a foreign father is
a Turkish citizen.
3)
If the child born outside the marriage union of a Turkish citizen father and a
foreign mother is fulfilled, he/she acquires Turkish citizenship if the
procedures and principles that ensure the establishment of lineage are
fulfilled.
According
to the provisions of the Law clearly stated above, the child; It is not
possible to register it in the Blue Card Holders Registry, as it acquires
Turkish citizenship by birth due to its parents, who are Turkish citizens on
the basis of lineage.
Can a Blue Card be issued on behalf of children?
For
children registered in the Blue Card Holders Registry, a separate document is
also issued in the name of these children upon the application of their
parents.
Do I absolutely have to get a Blue Card in order to be able to make transactions in any institution?
The
submission of the Blue Card is sufficient for exercising the rights specified
in Article 28 of the Turkish Citizenship Law No. 5901.
In
case the card cannot be presented, the transaction is carried out with the
registration sample to be taken from the Blue Card Holders Registry through the
Identity Sharing System and the document showing the identity information given
by the state authorities of which the nationality is located.
In
case of a change in the identity information of these persons, it is obligatory
to submit the document showing the old and new identity information obtained
from the state authority to which they are nationals, together with the duly
certified Turkish translation.
Can the Blue Card be used as a stand-alone identity document when doing business and transactions in official institutions?

Pursuant to the provision, the new Blue Card within the scope of valuable
papers can be used as an identity document.
Does the Blue Card have any validity period?
Blue
Card has no validity period.
Although I have a Blue Card, when I go to some institutions, I cannot make transactions because my population registration is closed. What is the reason of this?
The
identity information of the persons registered in the Blue Card Holders
Registry is shared with other institutions and organizations through the
Identity Sharing System (KPS).
Therefore,
the applied institution or organization should check the configuration in KPS
services.
In
other words;
The
information on the new Blue Card, which is within the scope of valuable papers,
is instantly shared with other institutions and organizations via KPS.
For
this reason, if a new blue card within the scope of valuable papers has been
issued on your behalf by the district population directorates or our foreign
representatives; The problem (your registration is not visible, your
information such as your name and surname still remains unchanged, etc.) is due
to the fact that the institution you want to process does not query your
information from the Blue Card Register.
Regarding
this problem, the applicant institution should carry out development work on
the Blue Card holders in the software they are using.
Although I have a Blue Card, I have difficulties in getting my transactions done in some institutions. How can I solve this problem?
In
the circular of the Prime Ministry dated 24/03/2005 and numbered 2005/6, the
practices to be made by institutions and organizations regarding the said Law
are clearly stated.
The
10th paragraph of the 28th article of the Turkish Citizenship Law No. 5901
states, “Public institutions and organizations take all kinds of measures and
make the necessary arrangements in order to implement the provisions of this
article.” is in effect.
Apply
to the Presidency for Turks Abroad and Related Communities, affiliated to the
Ministry of Culture and Tourism, regarding the problems encountered in practice
(when transactions cannot be made in institutions such as banks, SSI , land
registry, ptt , notary) regarding the said Law .
Is there a validity period for the Blue Card Holders
Identity Registration Sample?
The
validity period of the Blue Card Holders Population Registration Sample is 30
days.
Who can get the Blue Card for those over the age of 18?
Those
who are over the age of 18 will be given the Blue Card to themselves or their
official representative.
Who can get the Blue Card for those under the age of 18?
The
Blue Card for those under the age of 18 is given to the parents or guardians
and the person who is authorized to make a notification in order to register
the child in the family registers. In case the marriage union ends with a court
decision; The Blue Card of the minor child is given to the parent who has
custody. If the minor 's mother or father is abroad or has died, the person
appointed as a guardian by the court is authorized to receive the child's Blue
Card.
How soon do I need to change the Blue Card?
There
is no need to change the Blue Cards on which there is no erasure, scraping or
correction, and the information they carry is not hesitant. However, if the
person has changed in a way that prevents him from being recognized by the
photograph on his Blue Card, the Blue Card will be changed.
Can I get the Blue Card of my relatives?
Issued
Blue Card; It is essential that those who are adults (over the age of 18) are
given to themselves or their official representative, and for those who are not
adults, their parents or guardians and the person who has the authority to make
a notification in order to register the child in the Blue Card Register.
I'm going to change my Blue Card, won't I have a color photocopy?
Photocopied
or computer reproduced photos lose their qualities over time, so they are not
accepted and processed.
Is a receipt given for the price paid to the Blue Card?
According
to the provisions of the Valuable Papers Law No. 210, the Blue Card is a
valuable paper bought and sold from the treasurer's offices and serves as a
receipt, so no receipt is given for the price received.
I lost my Blue Card. Is there an obligation to advertise in the newspaper and notify the law enforcement authorities?
Announcing
in the newspaper and reporting to the police authorities regarding the lost
Blue Cards is a personal action of the individuals.
When the lost Blue Card is replaced by a new Blue Card, the lost Blue Card becomes legally invalid.
